I. GENERAL PROVISIONS
This document contains General Terms and Conditions under which “Parking Solutions” OOD, UIC 207952741 (hereinafter referred to as Park Aid), provides services – a platform for sharing parking spaces active throughout the territory of the Republic of Bulgaria through the website https://www.parkaid.bg and the Mobile Application Park Aid.
These terms and conditions are binding and mandatory for all Users of the Website and the Mobile Application, regardless of whether they are registered or not. By downloading the mobile application, creating a profile, creating an advertisement for rent and reserving a parking space, they agree, fully accept and undertake to comply with these General Terms and Conditions.
These General Terms and Conditions apply to your passive use of the Website and the Mobile Application, if you wish to rent a parking space through the Mobile Application, you will be bound by our Agreement with vehicle drivers (Drivers).
If you are the owner of a parking space and wish to rent it through us, you will be bound by our Agreement with parking space owners (Owners).
II. Registration
a. By clicking on the “Register” button, each User agrees to provide Park Aid with the minimum mandatory information for creating a user profile in the Mobile Application, namely:
i. Names
ii. Email
iii. Phone number
iv. Access password
III. Rights and obligations of users
a. If you are the owner of a Parking Space and wish to rent it, you bind yourself to Park Aid through the Agreement with parking space owners. If you are a driver of a motor vehicle and wish to rent a Parking Space, you are bound by the Agreement with Park Aid through the Vehicle Drivers Agreement.
b. The User has the opportunity to view the parking spaces advertised for rent in the Park Aid Mobile Application.
c. The User has the right to be informed about the status of his reservation for renting a parking space in the My Reservations section in his profile in the mobile application.
d. The User has no right to advertise directly or offer a service to other users without the express consent of Park Aid.
e. When using the service on the Website and the Mobile Application, each User, regardless of whether he is a registered user, owner of a parking space or others, undertakes:
i. not to violate and to respect the fundamental rights and freedoms of citizens and human rights, in accordance with the Constitution and laws of the Republic of Bulgaria and recognized international instruments;
ii. not to harm the good name of another and not to call for a violent change of the constitutionally established order, for the commission of a crime, for violence against the person or for inciting racial, national, ethnic or religious enmity;
iii. not to violate other people’s property or non-property, absolute or relative rights and interests, such as property rights, intellectual property rights, etc.;
iv. to comply with Bulgarian legislation, applicable foreign laws, the rules of morality and good manners and Internet ethics when using the services provided by Park Aid;
v. to notify the Park Aid team of any case of a committed or discovered violation when using the services provided;
vi. not to upload, send, transmit, distribute or use in any way and not to make available to third parties software, computer programs, files, applications or other materials containing computer viruses, unauthorized remote control systems („Trojan horses“), computer codes, or materials intended to interrupt, hinder, disrupt or limit the normal functioning of computer hardware or software or telecommunications facilities or aimed at unauthorized penetration or access to foreign resources or software;
vii. not to commit malicious acts;
viii. to indemnify Park Aid and all third parties for all damages suffered and lost profits, including any costs and attorneys’ fees paid, resulting from claims brought by and/or compensation paid to third parties in connection with Internet pages, hyperlinks, materials or information that the User has used, placed on the server, sent, distributed, made available to third parties or made available through https://www.parkaid.bg and the Park Aid Mobile Application in violation of the law, these General Terms and Conditions, Good Manners or Internet ethics;
f. The User undertakes to provide accurate and valid personal data described in accordance with our Personal Data Protection Policy. This data could include three names, contact phone number, car number, etc.
IV. Rights and obligations of Park Aid
a. Park Aid has the right, but not the obligation, to retain materials and information located on the Park Aid server,
b. Park Aid has the right to collect and use information relating to its Users.
i. The information under the previous article may be used by Park Aid, except in the case of explicit disagreement of the User, sent to the email address admin@parkaid.bg. It is collected and used in order to improve the services offered. All purposes for which the relevant information may be used will be in accordance with Bulgarian legislation, applicable international acts and good morals.
c. Park Aid is not liable for failure to fulfill its obligations under this contract in the event of circumstances that it did not foresee, could not and/or was not obliged to foresee – incl., cases of random events, problems in the global Internet network and in the provision of services beyond the control of Park Aid.
d. Park Aid has the right to install cookies on the computers of the Users. Cookies are text files that are saved by the website on the hard drive of each User, identifying them and allowing tracking of their actions, the websites they visit, the hyperlinks they use, the information they use and record, etc.
e. Park Aid may choose to terminate your rights to use the Mobile Application at any time by providing you with one month’s written notice in advance.

You can get more information about the services offered by Park Aid or send any other type of inquiries to the email and phone number specified in the „Contacts“ section of the Website.
VI. Intellectual Property
When accessing the site and mobile application, you agree to obey the law and respect the intellectual property rights of third parties. Use of the site and mobile application is subject to laws regarding the use of intellectual property. You agree not to download, display, perform, transmit, or otherwise distribute information or content in violation of third party copyrights, trademarks, or other intellectual property or proprietary rights. You agree to comply with the laws on ownership and use of intellectual property for copyright, and you are solely responsible for any violations of all relevant laws and for all violations of third party rights caused by any content that is provided or transmitted, or provided or transmitted under your username. The burden of proving that any content does not violate any laws or third party rights lies solely with you/the Users.
VII. Parking Space Usage Rules and Conditions
1. It is important for the effective management of the Parking Lot that you:
1. comply with all signs in the Parking Lot, including these General Terms and Conditions and all markings;
2. park within the boundaries of a marked parking space;
3. do not park in a space designated for a specific purpose when you are not entitled to do so (for example, without limitation, parking in a space designated for people with disabilities without an appropriate disability certificate, and/or marked pre-reserved spaces);
4. If you fail to comply with these requirements, we may issue you with a Parking Violation Notice requiring you to pay any unpaid parking charges together with an additional amount representing an estimate of the additional costs we will incur as a result of your non-compliance (including without limitation debt collection costs). Specific details of the parking violation charge are available at each Car Park.
5. Details/information on how to pay the parking violation charge, payment deadlines, what will happen if you do not make payment within the specified time frame, and the appeal process will be set out in the Parking Violation Notice.
6. By parking your vehicle in the Parking Lot, you agree to allow us to capture, use and process your registration number and personal data through video surveillance and automatic registration number recognition (where applicable) for the purposes of enforcing the rules, calculating the relevant parking fee (where applicable) and collecting any unpaid parking fees.
7. If the Parking Lot and/or the equipment in the Parking Lot are damaged by you, your vehicle, its contents or the occupants of the vehicle, then, unless the damage is a direct result of our negligence, we will seek to recover the costs of the repairs and related administrative costs from you.
8. Any parking space user is prohibited from towing another vehicle, except with the express consent of Park Aid
9. Any parking space user is prohibited from throwing objects and/or garbage on the territory of the rented property (Parking)
10. Any parking space user is prohibited from pouring and/or draining fuel from the vehicle located on the territory of the rented property, as well as from all other vehicles in the vicinity
11. Any parking space user is prohibited from smoking, as well as from consuming any alcoholic beverages on the territory of the Parking
12. Park Aid does not tolerate antisocial behavior on the territory of any Parking connected to the system.
VIII. Prices
1. The parking price that each Driver is obliged to pay varies depending on various factors such as time of stay, annual period, type of parking, etc. The final amount due will be displayed on our application. Drivers are obliged to pay the parking fee and comply with all instructions on the signs, as supplemented by these General Terms and Conditions.
2. Payment of the amount due is made by reference to the Stripe payment system. By agreeing to these General Terms and Conditions, Drivers confirm that they have read and understood the general terms and conditions of the Stripe payment system, which can be found here: https://stripe.com/en-bg/legal/ssa. Park Aid is not responsible for technical difficulties and/or inability to provide payment options due to technical malfunctions on a third-party website.
IX. Security
1. Each user is obliged to check whether the vehicle is left locked with the windows closed and the alarm, steering wheel lock or other similar device, if installed, is activated. We are not responsible for any consequences or losses arising from your failure to properly lock your vehicle.
2. All items left in the vehicle are the responsibility of the Vehicle Owner. Park Aid is not responsible for thefts committed by third parties of property left in the vehicle.
3. Park Aid reserves the right to request access to information recorded by CCTV cameras available on the territory of the rented parking spaces, if any, in order to assist in the proper management of abandoned vehicles
X. Abandoned vehicle
1. Any vehicle that is left for more than 7 days after the end of the rental period and without prior written notice is considered abandoned.
2. Park Aid reserves the right to engage and/or allow a legal authority to remove (or where we cannot identify the current legal registered owner of the vehicle, to take steps to remove) any abandoned vehicle. Before proceeding with the removal of abandoned vehicles, We will:
1. refer the matter to the appropriate authorities, which may include the local police;
2. attach a notice to the vehicle at least 2 days before the date on which we propose to remove the vehicle, stating that the vehicle will be removed after the expiration of this period;
3. Make an attempt to contact the owner of the vehicle at the address, telephone number and any other available information provided at least 2 days before the date of removal.
XI. Final provisions
1. The General Terms and Conditions may be changed at any time by the Park Aid team, which has the right to change the characteristics of the services provided. These General Terms and Conditions may also be changed on the basis of changes in the current legislation. Park Aid undertakes to notify each User of the changes to the General Terms and Conditions by publishing a notice of their changes in a prominent place on its website and giving sufficient time to familiarize themselves with them. If the User does not declare that he rejects the changes, then he is considered bound by them.
2. All disputes between the parties are resolved in a spirit of understanding and good will. In the event that agreement is not reached, all unresolved disputes, including disputes arising from or relating to its interpretation, invalidity, performance or termination, as well as disputes to fill gaps in the contract or adapt it to newly arising circumstances, will be resolved by the competent court of registration of Park Aid, in accordance with Bulgarian law.
