Information about the personal data controller:
The Park Aid website and mobile application (the Platform) are fully compliant with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“Regulation”), which entered into force on 25.05.2018, and the Personal Data Protection Act (“PDPA”).
By using the Platform, you accept and undertake to comply with this Personal Data Protection Policy, the Cookies Policy and the General Terms and Conditions of Park Aid.
We process your personal data on the following grounds:
1. Mandatory by law
2. Your explicit consent – the purpose is specified for each specific case;
3. Where required by law
In the following paragraphs you will find information about the processing of your personal data depending on the basis on which we process them.
FOR THE PERFORMANCE OF A CONTRACT OR IN THE CONTEXT OF PRE-CONTRACTUAL RELATIONS
We process your personal data in order to fulfill contractual and pre-contractual obligations and to exercise the rights under the contracts concluded with you.
Purposes of processing:
1. Described in the general terms and conditions of use of the Platform;
2. Where required by law;
We use an SSL certificate to ensure secure shopping for our customers. The certificate provides an encrypted connection between you and the Platform when you enter your personal data.
FOR FULFILMENT OF REGULATORY OBLIGATIONS
The law may provide for an obligation for us to process your personal data. In these cases, we are obliged to carry out the processing, such as:
● Obligations under the Anti-Money Laundering Measures Act;
● fulfillment of obligations in relation to distance selling, off-premises sales, provided for in the Consumer Protection Act;
● provision of information to the Consumer Protection Commission or third parties, provided for in the Consumer Protection Act;
● provision of information to the Personal Data Protection Commission in relation to obligations provided for in the legal framework for the protection of personal data;
● obligations provided for in the Accounting Act and the Tax and Social Security Procedure Code and other related regulatory acts, in relation to keeping legal accounting;
● providing information to the court and third parties, within the framework of proceedings before a court, in accordance with the requirements of the regulatory acts applicable to the proceedings;
● verification of age when shopping online.

We delete data collected pursuant to a statutory obligation after the obligation to collect and store it has been fulfilled or has expired. For example:
● under the Accounting Act for the storage and processing of accounting data (11 years),
● obligations to provide information to the court, competent state authorities, etc. grounds provided for in the current legislation (5 years).
When we are legally obliged to do so, we may provide your personal data to the competent state authority, natural or legal person.
AFTER YOUR CONSENT
Consent is a separate basis for processing your personal data and the purpose of the processing is specified in it, and is not covered by the purposes listed in this policy. If you give us the relevant consent and until its withdrawal or termination of any contractual relationship with you, we prepare suitable product/service offers for you.
We delete the data collected on this basis upon your request or 1 year after their initial collection.
We may use your Contact Data to communicate with you via email or other means of electronic communication (e.g. messages on websites, text messages, messages in Messenger applications or remote detailing/incl. customer services on request) to deliver marketing messages containing information about services, products or events related to your interests. However, marketing communications by email or other electronic means of communication („Electronic Marketing Communications“), as well as by telephone calls, are made only with your consent.
1. PERSONAL INFORMATION WE COLLECT.
1.1 Information necessary to use the Park Aid Platform. We collect personal information about you when you use the Park Aid Platform. Without it, we may not be able to provide all requested services. This information includes:
1.1.1 Contact, account and profile information. Such as your name, surname, telephone number, postal address, email address, date of birth and profile picture, some of which will depend on the features you use.
1.1.2 Identity information. Where appropriate, we may ask you for an image of your government-issued ID (in accordance with applicable laws) or other verification information and/or a selfie when verifying your identity. If we are provided with a copy of your ID, we will receive information from your ID.
1.1.3 Payment information. Such as payment account or bank account information. If you are not a Park Aid user, we may receive payment information related to you, such as when a Park Aid user provides your payment card to complete a booking.
1.2 Information you choose to provide to us. You may choose to provide us with additional personal information, including:
1.2.1 Additional profile information. Such as gender, preferred language(s), city and personal description.
1.2.2 Other information. Such as when you fill out a form, add information to your profile, respond to surveys, post in community forums, participate in promotions, communicate with Park Aid support and other members, import or manually enter contacts into your address book, provide your address and/or geolocation, or share your experiences with us. This may include health information if you choose to share it with us.
1.3 Information collected automatically through your use of the Park Aid Platform and our payment services. When you use the Park Aid Platform and payment services, we automatically collect certain information. This information may include:
1.3.1 Geolocation information. Such as precise or approximate location determined by your IP address, GPS on a mobile or other device, or other information you share with us, depending on your device settings. We may also collect this information when you are not using the application if you enable this through your device settings or permissions.
1.3.2 Usage Information. Such as searches for Listings, reservations you have made, additional services you have added, access dates and times, the pages you have viewed or engaged with before or after using the Park Aid Platform, and other actions on the Park Aid Platform, including the pages or content you view and links you click on to third-party applications. We may collect this information even if you have not created a Park Aid account or are not logged in.
1.3.3 Device Information. Such as IP address, hardware and software information, device information, device event information, unique identifiers, crash data and read receipts. We may collect this information even if you have not created a Park Aid account or are not logged in.
1.3.4 Cookies and similar technologies, as described in our Cookie Policy.
1.3.5 Payment Transaction Information. Such as payment instrument used, date and time, payment amount, payment instrument expiration date and billing zip code, email address.
1.4 Information We Collect from Third Parties. We may collect personal information from other sources, such as:
1.4.1 Third-party applications. If you choose to connect, link or log in to the Park Aid Platform with a third-party service, such as Google, Facebook and others, you direct the service to send us information, such as your registration, friends list and profile information, controlled by that service or authorized by you through your privacy settings in that service.
1.4.2 General information providers. For members in the European Union, to the extent permitted by applicable law, we may receive, for example, criminal record reports, sex offender registrations and other information about you and/or your background.
1.4.6 Complainants. If a parking space owner, guest or third party files a complaint against you, we may receive information related to the specific complaint in order to understand and, where applicable, review the complaint.
1.4.7 Financial institutions. If you choose to pay with funds from your bank account, we may receive certain information from your financial institution, such as bank account details and account balance.
1.4.9 Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as references, demographic data and information to help detect fraud and safety issues from (i) third-party service providers, other third parties and/or partners, or (ii) members and other individuals, entities and authorities, and combine it with the information we have about you. For example, we may receive background check results or fraud alerts from identity verification service providers to use in our fraud prevention, security investigation and risk assessment efforts. We may receive information about you and your activities on and off the Park Aid Platform, including from Park Aid users, members of the public, government, public or tax authorities, or about your experiences and interactions with our partners. We may receive health information, including, but not limited to, health information related to communicable diseases.
1.5 Video Recordings – Park Aid may obtain access to video recordings from Property Owners in the event of a legitimate request from supervisory/regulatory authorities. These are images recorded by CCTV and other equipment located on the territory of the rented property and/or at the entrance/exit to it.
2. HOW WE USE THE INFORMATION WE COLLECT. We use personal information as set out in this Privacy Policy.
2.1 Provide, improve and develop the Park Aid Platform. We may process this information to:
• allow you to access the Park Aid Platform and make and receive payments,
• allow you to communicate with others,
• process your request,
• perform analytics, troubleshoot and conduct research,
• develop and improve our products and services,
• provide customer service training,
• send messages, updates, security alerts and account notifications,
• personalise your experience based on your interactions with the Park Aid Platform, your search and booking history, your profile information and preferences and other content you submit, and
• enable the use of our accommodation products and services.
2.2 Protect the Park Aid Platform and community. We may process this information to:
• detect, prevent, assess and address fraud and security risks,
• verify or authenticate information you provide, including identity information as described in Information Required to Use the Park Aid Platform,
• perform checks against databases and other sources of information, including background checks,
• comply with our legal obligations, protect the health and well-being of our guests, space owners, employees of the owners and members of the public,
• resolve disputes with our members, including sharing information with your secondary space owners or additional guests regarding disputes relating to your role as a co-host(s) or additional guests,
• enforce our agreements with third parties,
• determine eligibility for certain types of reservations, such as instant booking,
• comply with the law, respond to legal requests, prevent harm and protect our rights
, • enforce our Terms and other policies
, • evaluate your interactions with the Park Aid Platform and information received from third parties.
In certain cases, automated processes that analyze your account and activities on the Park Aid Platform, as well as information regarding activities on and off the Park Aid Platform that may be associated with you, may limit or terminate your access to the Park Aid Platform if these processes detect activity that may pose a safety or other risk to Park Aid, our community or third parties. If you wish to challenge decisions based on automated processes, please contact us via the Contact Information section.
2.3 We provide, personalize, measure and improve our advertising and marketing. We may process this information to:
• send you promotional and marketing messages and other information,
• display, personalize, measure and improve our advertising on advertising platforms,
• administer referral programs, rewards, surveys, sweepstakes, competitions or other promotional activities or events sponsored or managed by Park Aid or its third-party partners;
• analyze your characteristics and preferences to send you promotional messages, marketing, advertising and other information that we believe may be of interest to you, and
• invite you to events and relevant opportunities.
2.4 Analyze and Share Your Communications. We may review, scan or analyze your communications on the Park Aid Platform for the reasons set out in the “How We Use the Information We Collect” section of this policy, including fraud prevention, security investigations, risk assessment, regulatory compliance, product development, research, analytics, enforcement of our Terms of Service and for customer support purposes. For example, as part of our fraud prevention efforts, we scan and analyze communications to mask contact information and links to other sites and, subject to applicable law, scan and analyze all images uploaded by users of the Park Aid Platform in message threads, profiles, listings and experiences for certain illegal or inappropriate activities – such as evidence of child exploitation – in order to identify and report content violations to the appropriate authorities. In some cases, we may also scan, review or analyze communications to fix errors, improve and expand product offerings. We use automated methods where reasonably possible. We may occasionally need to manually review communications, such as for fraud investigations and customer support, or to evaluate and improve the functionality of these automated tools. We will not review, scan or analyze your communications to send you marketing communications to third parties, and we will not sell reviews or analytics of these communications. We may also share your communications as set out in the “Sharing and Disclosure” section.
2.5 Provision of Payment Services. Personal information is used to enable or authorize third parties to use payment services, such as:
• detecting and preventing money laundering, fraud, abuse and security incidents, and performing risk assessments;
• complying with legal and compliance obligations, such as anti-money laundering and sanctions regulations;
• enforcing the Payment Terms and other payment policies; and
• providing and improving payment services.
3. DATA SHARING AND DISCLOSURE
3.1 Sharing with your consent or at your direction. When you provide consent or direct us to share your information, we share your information as described at the time of consent or choice, such as when you authorize a third-party application or website to access your Park Aid account, process an insurance claim, apply for flexible payment and financing products, or participate in promotional activities from Park Aid partners or third parties.
3.2 Who We Share With. We may share your information with:
3.2.1 Other Members. To facilitate bookings or other interactions between Members (who may be located or using service providers located in jurisdictions with different levels of data protection)
3.2.3 Parking Management. We may share Owners’ and Guests’ Personal Information with the owner(s) of the parking space, the parking space owners’ association and/or their agent, such as a property management company (“Building Management”), including booking information and information related to compliance with applicable laws. Guest booking and personal information, including Guest contact information, may be shared with the management of the building, complex or community where the Host resides and/or the Listing is located to facilitate hosting services, compliance with applicable laws, security, billing and other services.
3.2.5 Service Providers. We share personal information with affiliated and unaffiliated service providers (including their service providers) to help us operate our business and for their compliance purposes, including those who help us: (i) confirm your identity or verify your identity documents, (ii) check information against public databases, (iii) perform due diligence, fraud prevention, security investigations and risk assessments, (iv) perform product development, maintenance and troubleshooting, (v) enable the provision of the Park Aid Services through third-party platforms and software tools, (vi) provide customer service, advertising or payment services, (viii) process, process or assess insurance claims or similar claims, (ix) review, scan and analyze communications on the Park Aid Platform for certain purposes, such as evidence of child exploitation, or (x) offer flexible payment and financing plans provided by a third-party credit provider. These providers are contractually obligated to protect your personal information, have access to your personal information to perform these tasks, and may also disclose your information when required to do so by law.
3.2.6 Corporate Affiliates. To support us in providing, integrating, promoting, and improving the Park Aid Platform, payment services, and our affiliates’ services, we may share personal information within our corporate family of companies, including:
3.3 Why We May Share Your Information. We may share your information to:
3.3.1 Build your public profile. Information you share publicly on the Park Aid Platform may be indexed by third-party search engines. In some cases, you can opt out of this sharing in your account settings. We may make certain information publicly visible to others, such as:
• listing pages, which include information such as an approximate or precise description of the location of the accommodation or experience, calendar availability, profile photo, search summary information, and additional information you choose to share,
• reviews, ratings, and other public feedback, and
• content in a community or discussion forum, blog, or social media post, as well as content you make publicly available, including details of your listing on third-party sites, platforms, and applications.
3.3.2 Comply with the law, respond to legal requests, prevent harm, and protect our rights.
3.3.2(i) Disclosure. We may disclose your information to courts, law enforcement agencies, government or public authorities, tax authorities, authorized third parties or other members if and to the extent we are required or permitted to do so by law or where disclosure is reasonably necessary to: (i) comply with our legal obligations, (ii) comply with a valid legal request, such as a subpoena or court order or in response to claims brought against Park Aid, (iii) respond to a valid legal request related to a criminal investigation to address suspected or alleged illegal activity, or to respond to or address any other activity that may expose us, you or any of our users to legal or regulatory liability, respond to requests for or in connection with current or future legal claims or legal proceedings involving Park Aid and/or third parties, in accordance with applicable law, or (vi) protect the rights, property or personal safety of Park Aid, its employees, its members or members of the public.
3.3.2(i)(a) To Tax Authorities. Where required or permitted by applicable law, we may disclose Owner and/or Guest Information to the relevant tax authorities or other government agencies, depending on where you are located, for the purposes of determining by the tax authorities whether you are properly complying with relevant tax obligations.
3.3.2(i)(b) To government agencies for registrations, notifications, permits or applications or license numbers. In jurisdictions where Park Aid facilitates or requires registration, notification, permits or applications for a parking space owner license or number with a government agency, we may share information about participating parking space owners with the relevant agency during the application process, when the listing is posted and periodically thereafter.
3.3.2,ii) Notification. Where appropriate and/or legally required, we may notify members of legal claims unless: (i) providing notice is prohibited by the legal process itself, a court order we receive, or applicable law, or (ii) we believe that providing notice would be futile, ineffective, would create a risk of injury or bodily harm to a person or group, or create or increase the risk of fraud or harm to Park Aid, our members, or expose Park Aid to a claim for obstruction of justice.
3.3.3 Making Business Transfers. If Park Aid undertakes or is involved in a merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your information, in connection with such a transaction or in the consideration of such a transaction, such as a due diligence exercise. In this case, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.
4. THIRD PARTY PARTNERS AND INTEGRATIONS.
4.1 Connecting Third Party Services. You may connect your Park Aid account to certain third party services, such as social networks. When you direct data sharing by creating this link:
• some of the information provided to us by the linking accounts may be published on your public profile,
• the information you provide to us from linking your accounts may be stored, processed and transmitted for the purposes of fraud prevention, security investigations and risk assessment,
• we share information about your reservation with third party travel partners and rewards programs, and
• the publication and display of the information you provide to the Park Aid Platform through this link is subject to your settings and permissions on the Park Aid Platform and the third party service.
4.2 Third-Party Service Terms. Portions of Park Aid may link to third-party services. Park Aid does not own or control these third parties. When you interact with these third parties and choose to use their service, you are providing them with your information. Your use of these services is subject to the privacy policies of these providers, including the terms of the Stripe payment system.
5. User Rights
Every User of the site enjoys all rights to protect personal data under Bulgarian legislation and European Union law.
Each User has the right to:
● Information (in relation to the processing of his/her personal data by the administrator);
● Access to his/her own personal data;
● Correction (if the data is inaccurate);
● Erasure of personal data (right to be forgotten);
● Restriction of processing by the administrator or processor of personal data;
● Portability of his/her own personal data between different administrators
; ● Objection to the processing of his/her personal data;
● The data subject also has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects for the data subject or similarly significantly affects him/her;
● Right to judicial or administrative redress in the event that the rights of the data subject have been violated.
The user may request erasure if one of the following conditions is met:
● The personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
● The user withdraws his or her consent on which the processing of the data was based and there is no other legal basis for the processing;
● The user objects to the processing and there are no overriding legitimate grounds for the processing;
● The personal data have been processed unlawfully;
● The personal data must be erased for compliance with a legal obligation under European Union law or the law of a Member State to which the controller is subject;
The User has the right to restrict the processing of his/her personal data by the Administrator when:
● He/she disputes the accuracy of the personal data. In this case, the restriction of processing shall be for a period that allows the Administrator to verify the accuracy of the personal data;
● The processing is unlawful, but the User does not want the personal data to be deleted, but instead requests the restriction of their use;
● The Administrator no longer needs the personal data for the purposes of the processing, but the User requires them for the establishment, exercise or defense of legal claims;
● He/she objects to the processing pending verification of whether the legitimate grounds of the Administrator override the interests of the User.
Right to portability.
The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and shall have the right to transmit those data to another controller without hindrance from the controller to whom the personal data have been provided, where the processing is based on consent or a contractual obligation and the processing is carried out by automated means. When exercising the right to data portability, the data subject shall also have the right to obtain the direct transmission of the personal data from one controller to another, where technically feasible.
Right to object.
Users have the right to object to the processing of their personal data to the controller. The controller is obliged to stop the processing unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims. In the event of an objection to the processing of personal data for direct marketing purposes, the processing shall cease immediately.
Complaint to the supervisory authority
Every User has the right to file a complaint against unlawful processing of his/her personal data to the Personal Data Protection Commission or to the competent Bulgarian court.

7. CHANGES TO THIS PRIVACY POLICY. We reserve the right to change this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. In the event of material changes, we will also notify you of the change by email at least thirty (30) days prior to the effective date. If you do not agree to the revised Privacy Policy, you may terminate your account. If you do not terminate your account prior to the effective date of the revised Privacy Policy, your continued access to or use of the Park Aid Platform will be subject to the revised Privacy Policy.
