This Agreement governs the relationship between Park Aid and all parking space owners (“Owners”) who use our Services. When using the Services, we provide you with the means to enter into individual, direct agreements with motor vehicle drivers (“Drivers”) for the rental of your Parking Space.
When you accept reservations for Parking Spaces using the Services (“Reservations”) and allow Drivers to use your Parking Space(s), you enter into individual, direct agreements with those Drivers. You shall be bound by your obligations under this Agreement and any additional obligations included in the Parking Space listing.
We are not a party to the agreement between you and the Drivers and shall not be liable to you, the Driver, or any third party for any breach of obligations relating to the Parking Space, whether stated in this Agreement or in Parking Space listings.

This Agreement is entered into with you, the person using the Services. You undertake to comply with the terms of this Agreement and all additional requirements related to renting out the Parking Space. If you allow another person to assist with managing a reservation or Parking Space, you agree that you remain fully responsible for the reservation and the Parking Space and/or charging point.

1. Publishing a Parking Space Listing

1. To publish a listing for your Parking Space, you must register an account in accordance with our General Terms and Conditions.
2. We may advertise your Parking Space on our Website, Mobile Application, and selected third-party websites to increase exposure to potential Drivers.
3. You must complete your own listing in the Mobile Application, providing all necessary information, including:
   i. address and full description of the Parking Space, including photographs where applicable;
   ii. any restrictions on vehicle types unsuitable for the Parking Space;
   iii. permissible vehicle dimensions;
   iv. any other applicable information or restrictions, including access limitations;
   v. where installed, full details of electric vehicle charging equipment, including additional rules and fees.
4. You must also provide your name, address, email address, and phone number before the Parking Space is listed.
5. You agree to provide any additional information reasonably requested by us at any time, including identity documents, proof of ownership, or access to CCTV recordings on the Parking Space premises.
6. You are responsible for the accuracy of all information provided. You may be liable to Drivers if information is inaccurate, incomplete, or misleading.
7. If you provide equipment (e.g. EV charging cables), you are responsible for such equipment and for any damage caused by its use, except where the Driver fails to follow instructions. Park Aid bears no liability.
8. We reserve the right to conduct physical inspections with reasonable notice and to remove listings that do not meet stated information or our standards.
9. We may send promotional communications to Drivers regarding your Parking Space, subject to applicable permissions.
10. We may reference your Parking Space in marketing materials; residential addresses will not be publicly disclosed.

1. Agency Services

1. You appoint us as your agent for concluding binding agreements between you and Drivers and authorize us to collect payments on your behalf.
2. A binding agreement between you and the Driver is formed once the reservation is confirmed and payment received.
3. You may not impose additional conditions beyond those clearly stated in your listing.

III. Reservations and Payment

1. Your Parking Space is considered available unless you indicate otherwise. Failure to update availability may result in liability for alternative arrangements (up to BGN 100 incl. VAT).
2. We manage the reservation process and collect payments on your behalf.
3. Upon confirmed payment, a binding agreement is formed.
   • Up to 30 days: Full payment collected at booking; payout within 45 days.
   • Over 30 days: First month paid at booking; subsequent monthly payments collected in advance.
4. You authorize us to accept and hold payments and may be required to provide debit or credit card details for payouts or deductions.

1. License for Parking Space (and EV Charging Equipment)

1. You must ensure the Parking Space and all equipment match the listing and are fit for use.
2. Overstays are chargeable at the full rate; Park Aid may collect such fees on your behalf.
3. You confirm you own or are authorized to rent out the Parking Space and comply with all applicable laws.
4. You confirm authorization to provide EV charging facilities and must suspend availability if equipment is faulty.
5. You must notify us immediately of any notices from authorities or property managers.
6. Park Aid bears no responsibility for your legal non-compliance.

1. Dispute Resolution

1. You agree to first attempt direct resolution with the Driver.
2. You authorize Park Aid to process refunds where required and recover amounts from you if necessary.
3. These provisions survive termination.
4. Park Aid is not responsible for disputes between Owners and Drivers.

1. Reservation Cancellation

1. Cancellations must comply with this Agreement and the General Terms.
2. Park Aid acts as your agent in handling cancellations.
3. You authorize refunds to Drivers where applicable.
4. Failure to refund may result in account termination.
5. Determination of extraordinary circumstances and refunds is at Park Aid’s discretion.
6. Park Aid may attempt to arrange alternative parking but offers no guarantees.
7. Non-extraordinary Owner cancellations require full refunds and compensation up to €45 per day.

VII. Obligations of Parking Space Owners

Owners agree to:

• honor all reservations;
• ensure availability and safety;
• provide accurate listings;
• maintain cleanliness and equipment functionality;
• respond promptly and professionally to Drivers;
• provide CCTV footage upon justified request;
• cover electricity costs for EV charging;
• make reasonable efforts to resolve disputes.

Creating false accounts or engaging in illegal activity is prohibited.

VIII. Account Suspension and Termination

1. Non-compliance may result in immediate suspension or termination without notice.
2. Attempts to circumvent termination may result in permanent exclusion.
3. Outstanding reservations must be refunded.
4. You may terminate this Agreement with one month’s notice.

1. Insurance

You are solely responsible for obtaining any required insurance related to renting out your Parking Space.

1. Liability of Park Aid

1. Services are used at your own risk. Park Aid does not verify Drivers or guarantee service availability.
2. You are solely responsible for interactions with Drivers.
3. Park Aid is not liable for indirect losses, inaccuracies, or events beyond its control.

1. Data Protection and Data Sharing

1. All parties must comply with Bulgarian data protection law and GDPR.
2. Driver data may be shared solely for reservation purposes.
3. Park Aid may audit compliance.
4. Shared data must be treated as personal data.
5. Owners acting as data controllers must meet GDPR obligations, including security, access requests, breach notifications, and record keeping.

XII. Final Provisions

1. This Agreement terminates by mutual consent or fulfillment.
2. Termination does not cancel existing payment obligations.
3. Confidential information must be protected.
4. Invalid clauses do not affect the remainder.
5. Amendments must be in writing.
6. Disputes shall be resolved amicably, failing which they shall be heard by the competent court in Plovdiv, Republic of Bulgaria.
7. Bulgarian law applies to all matters not covered herein.
