Payment Terms

These Payment Terms (“Payment Terms”) constitute a binding legal agreement between you and Park Aid and govern the payment services (defined below) carried out through or in connection with the Park Aid Platform. When these Payment Terms refer to “payments in Park Aid,” “we,” “us,” or “our,” this refers to Park Aid.
Park Aid provides payment services to Members who publish, offer, reserve, and rent parking spaces or other owner-related services, including services related to programs and other current and future services offered through the Park Aid Platform. These payment services are provided for the benefit of Owners and Drivers and may include (where applicable) the following (collectively, the “Payment Services”):
- Collection of payments from Drivers (“Payment”), by charging the payment method provided by the Driver or linked to their Park Aid account, such as a credit card, debit card, bank account, or installment product provided by a credit provider. Payments are processed via Stripe (“Payment Method”). Stripe’s general terms are available at: https://stripe.com/en-bg/legal/ssa;
- Payments to Owners (“Payouts”), to a financial instrument linked to their Park Aid account, such as a bank account, prepaid card, or debit card (“Payout Method”).
- Park Aid Payment Services
1.1 Use of Payment Services
By using the Payment Services, you agree to comply with these Payment Terms. Park Aid may temporarily restrict or suspend your access to or use of the Payment Services or their features in order to perform maintenance activities necessary to ensure their proper functioning.
1.2 Third-Party Services
The Payment Services may include links to third-party websites or resources (“Third-Party Services”). Such services are subject to separate terms of use and privacy policies, which Members should review. Park Aid is not responsible for the use of Third-Party Services, and links to such services do not constitute endorsement by Park Aid.
1.3 Your Park Aid Account
Park Aid may enable features allowing you to authorize other Members or third parties to take certain actions affecting your Park Aid account. You may authorize a third party to use your account if such functionality is enabled. You acknowledge and agree that anyone you authorize may use the Payment Services on your behalf, and you remain responsible for all payments made by that person.
1.4 Identification and Verification
You authorize Park Aid, directly or through third parties, to make any inquiries deemed necessary to verify your identity and the information you provide, and where applicable, to verify the identity of representatives and beneficial owners. This may include:
(i) verification through third-party databases or other sources;
(ii) requests for reports from service providers;
(iii) requests for official identification (e.g., driver’s license or passport) to verify name, place and date of birth, address, nationality, or other required information; or
(iv) requiring steps to confirm ownership of your email address, payment method(s), or payout method(s).
Park Aid reserves the right to terminate, suspend, or limit access to the Payment Services if such information cannot be obtained or verified.
1.5 Additional Terms
Access to certain Payment Services may require acceptance of additional terms. In case of conflict between these Payment Terms and terms applicable to a specific payment service, the latter shall prevail unless otherwise stated.
- Terms for Drivers
2.1 Adding a Payment Method
When adding a Payment Method to your Park Aid profile, you will be asked to provide payment information such as name, billing address, and financial instrument details, either to Park Aid or its third-party payment processors. You authorize Park Aid and its payment partners to collect and store such information in accordance with Park Aid’s Privacy Policy.
2.2 Verification of Payment Method
When adding or using a new Payment Method, Park Aid may verify it by:
(i) authorizing one or two nominal amounts and requesting confirmation; or
(ii) requesting that you upload a payment statement.
Park Aid may initiate refunds of such amounts. You may not remove a Payment Method linked to a reservation from the date of reservation until fourteen (14) days after the departure date, nor during any additional period required to resolve outstanding damage claims.
2.3 Obligation to Pay
You agree to pay all applicable fees and amounts (including taxes) related to your Park Aid account, including amounts arising from damage claims under the General Terms.
2.4 Updating Payment Method
You agree to update your Payment Method if details change (e.g., card number, routing number, expiration date, CVV/CVC).
2.5 Time of Payment
Park Aid will collect the total amount due at the time of your reservation request or once the Owner accepts the reservation request. If Park Aid cannot collect the amount, the reservation cannot be confirmed.
2.7 Reservation Request Status
If a reservation request is rejected, canceled, or canceled by Park Aid, any collected amounts due to you will be refunded in accordance with Section 5.5, and any pre-authorization will be released where applicable.
2.8 Payment Restrictions
Park Aid reserves the right to refuse or limit payments that may:
(i) violate risk management rules;
(ii) breach these Payment Terms;
(iii) be unauthorized, fraudulent, or illegal; or
(iv) expose you, Park Aid, or others to unacceptable risk.
2.9 Payment Service Providers
Payment Methods may involve third-party providers who may charge additional fees. Park Aid is not responsible for such fees.
2.10 Your Responsibility
Park Aid is not responsible for losses resulting from incorrect payment information provided by you. Park Aid does not provide regulated payment services.
- Terms for Owners
3.1 Collection of Payments
Park Aid generally collects the total reservation price when the Driver’s reservation request is accepted, unless otherwise stated.
3.2 Valid Payout Method
To receive payouts, you must have a valid Payout Method linked to your Park Aid account and provide required information. Failure to provide or validate information may result in delayed or suspended payouts.
3.3 Payout Timing
Subject to successful receipt of payments from Drivers, Park Aid generally initiates payouts up to forty-five (45) days after the end of the rental period.
3.4 Payout Amount
Payouts equal the total price minus applicable fees, taxes, and agreed distributions to co-owners or agents. In case of cancellation, payouts are handled according to the applicable cancellation policy.
3.5 Payout Restrictions
Park Aid may withhold, suspend, or cancel payouts to prevent fraud, assess risk, comply with legal requirements, or due to force majeure events.
- General Provisions
4.1 Fees
Park Aid may charge fees for certain Payment Services, disclosed via the Platform or applicable terms.
4.2 Payment Authorizations
You authorize Park Aid to collect amounts due by charging your Payment Method or deducting from future payouts, including fees, damages, penalties, refunds, and other amounts described in these Payment Terms.
Uncollected amounts may be recovered through recharging payment methods, deductions, or debt collection actions.
- Collection, Errors, and Refunds
5.3 Collection of Outstanding Amounts
Unpaid amounts may be subject to collection efforts and considered overdue or in default after specified periods.
5.4 Payment Processing Errors
Park Aid will correct processing errors and recover funds paid in error. You agree to promptly return any funds received by mistake.
5.5 Refunds
Refunds are initiated by Park Aid according to these Payment Terms. Processing times depend on the payment method and applicable payment system rules.
- Disclaimers
Use of Payment Services is voluntary and at your own risk. Park Aid disclaims liability for actions or omissions of Members or third parties to the maximum extent permitted by law.
- Liability
Park Aid’s liability is limited to the maximum extent permitted by law and does not cover indirect losses such as loss of business, reputation, or profits.
- Indemnification
You agree to indemnify Park Aid against claims arising from your breach of these Payment Terms, misuse of the Payment Services, tax failures, or legal violations, to the extent caused by your negligence or breach.
- Amendments, Term, and Termination
Park Aid may amend these Payment Terms with at least two (2) months’ notice. You may terminate at any time by closing your account. Park Aid may terminate for convenience or immediately for cause.
- Governing Law and Dispute Resolution
These Payment Terms are governed by Bulgarian law. Consumers may bring claims only before competent Bulgarian courts, subject to mandatory consumer protection rules. Businesses submit to the exclusive jurisdiction of Bulgarian courts.
