Parking Solutions Ltd. (trading as Park Aid) (“we”, “us”, or “Park Aid”) provides a website and mobile application and related services connecting registered Park Aid owners who have parking spaces, charging points, or vehicle and bicycle storage spaces (“Owners”) with those who wish to reserve such parking spaces, charging points, or storage spaces (“Services”).
These General Terms apply to all Services provided or arranged by Park Aid to or for you, the recipient of the Services (“Driver” or “you”).

This Agreement governs the relationship between you and us. When you use the Services, we provide you with the means to enter into direct contracts with Owners for the parking of the Owner’s parking space (“Parking Spaces”). You, as the end user, agree that you are bound by your obligations under this Agreement and all additional obligations included in the listing related to a Parking Space, as described in our General Terms and Conditions.
Park Aid is not the owner of any parking space, is not a party to the agreement between you and the Owner, and shall not be liable to you, the Owner, or any third party for any breach of obligations related to the parking space, whether specified in this Agreement, in listings related to a parking space, or otherwise. We merely connect Drivers and Owners and facilitate payment for the rental of parking spaces provided by Owners.

1. Registration

1. To make a reservation, you must register an account in accordance with our General Terms and Conditions.
2. After creating an account, you undertake to provide the registration number of the vehicle for which you are making the reservation, as well as any other appropriate additional information that may be required.
3. Reservation confirmations and other relevant information regarding the Services will be sent to the email address and/or telephone number you provide.
4. Please ensure that your contact details are correct, as we shall not be liable if, due to inaccuracies provided by you and/or technical issues, you do not receive a reservation confirmation or other information you may expect. If you notice that your email address is incorrect, please contact us so we can correct it.

1. Reservation Arrangement

1. The Owner grants you the right to use the Parking Space covered by the reservation for the duration of that reservation (“Reservation Period”), and you authorize us to collect your reservation fees on behalf of the Owner.
2. Once we confirm the reservation and receive payment from you, this Agreement shall be deemed validly concluded and binding between you and the Owner of the parking space.

III. Inquiries and Reservations

1. If you wish to use a Parking Space advertised in the Mobile Application, you may do so via one of two methods: Instant Reservations and Approved Reservations. Parking Spaces offered for short-term rental (less than 3 days) are instantly approved. Parking Spaces offered for long-term rental (more than 3 days) require Owner approval.
2. If a Parking Space is available for reservation, its availability will be shown in its listing. If your desired dates are available, you may select the required dates and times.
3. After selecting the dates and times, we will request payment from you. By proceeding with payment, you accept the terms of this Agreement and any additional conditions for the Parking Space stated in the listing.
4. Once payment is received and you accept the terms of this Agreement, your reservation will be confirmed and you will enter into a binding agreement with the Owner for the use of the Parking Space. We will provide reservation confirmation in the reservations section of the Mobile Application, including the Owner’s contact telephone number and detailed instructions related to the reservation, including the Reservation Period.

1. Payment upon Reservation

1. For any reservation period of 30 days or less, you must pay the full amount due at the time this Agreement is concluded. For reservations longer than 30 days, payment may be made in equal consecutive monthly installments (with the initial installment being no less than the amount for one month of reservation).
2. We are authorized by the Owner to accept payment from you on the Owner’s behalf.

1. License for the Reservation Period

1. You may use the Parking Space only during the Reservation Period.
2. Each reservation is valid only for the vehicle details provided at the time of reservation. If you wish to change the vehicle details (e.g., registration number), you must contact us by email. If you wish to change your dates, you must cancel the reservation and make a new one for the correct dates.
3. Amounts blocked in the event of a cancellation made by you more than 24 hours before the start of the rental period will be refunded according to the payment method used—either to your bank card or to your in-app wallet—after deduction of fees under Section VII. In the event of cancellation by the Owner, you will receive a full refund.
4. During your reservation, if you have any concerns or inquiries regarding the Parking Space, you should contact the Owner using the telephone number or email provided in the listing.
5. Upon arrival at the Parking Space at the start of your Reservation Period, you must inspect the Parking Space and ensure it matches the description in the listing. If there is any issue or discrepancy, please contact us using the information in the “Contacts” section of our Website.
6. Unless the Owner has agreed to a later departure time or an additional reservation period, you will be required to pay the full price for any additional time stayed.

1. Complaints and Disputes

1. You agree that if you have any dispute with the Owner regarding the Owner or their Parking Space during the Reservation Period, you will first attempt to resolve it directly with the Owner.
2. If the dispute cannot be resolved directly, you may refer it to our team for assistance in resolving the matter more quickly. However, you agree that Park Aid bears no responsibility for disputes between the parties.
3. If the Owner must refund you an amount and the payment has not yet been transferred by Park Aid, we may refund the amount on the Owner’s behalf. If the Owner has already received the payment, you are responsible for requesting the refund directly from the Owner.
4. If at any time the Owner is or is controlled by Park Aid, we will use an independent third party to assist with dispute resolution (mediator).
5. You agree that the provisions of this clause shall remain in force after termination of this Agreement.

VII. Cancellation and Termination

1. Reservation not yet approved by the Owner: The Driver must cancel the reservation via the Park Aid Mobile Application from their profile. The cancellation notice is deemed received at the moment the cancellation request is submitted. Park Aid is not responsible for transmission issues.
2. Reservation approved by the Owner: The Driver may receive a full refund of the transaction amount, excluding the platform fee, for any reason by cancelling via the Mobile Application at least 24 hours before the start of the rental period.
3. As a rule, cancellations made less than 24 hours before the rental period begins are non-refundable.
4. If the Driver does not cancel via the Park Aid cancellation procedure, the full amount and platform fee will be due and no refund will be issued.
5. In the event of extraordinary circumstances beyond the Driver’s reasonable control, the Driver may request an extraordinary cancellation and refund by informing Park Aid before the rental period begins.
6. Whether a cancellation qualifies as extraordinary and whether a refund is due shall be determined solely at Park Aid’s discretion, and all parties agree that Park Aid’s decision shall be binding.
7. If the Owner must cancel due to extraordinary circumstances beyond their reasonable control, the Owner agrees to inform Park Aid. Park Aid may contact the Driver with offers of a suitable alternative parking space from another registered Owner.
8. Park Aid does not guarantee that an alternative parking space can be found and shall not be liable for failure to fulfill a reservation or for alternative parking costs or other expenses arising directly or indirectly from a breach of this Agreement.
9. If the Owner cancels and the circumstances are not extraordinary or beyond their reasonable control, the Driver is entitled to a full refund, including the service fee (if no suitable alternative is provided), and the Owner agrees to cover additional alternative parking costs (up to €45 per day).
10. Whether the Owner’s cancellation qualifies as extraordinary and whether the Owner is responsible for additional costs shall be determined solely at Park Aid’s discretion, and all parties agree that Park Aid’s decision shall be binding.

VIII. Obligations of Vehicle Drivers

1. Each Driver undertakes to:
   i. comply with this Agreement;
   ii. not use the Parking Space or interact with the Owner in a manner harmful to Park Aid’s business or reputation;
   iii. provide accurate information and keep all stored data (including phone number and email) up to date;
   iv. not create false accounts or use the account for immoral or illegal activities, including fraudulent reservations or money laundering;
   v. bear primary responsibility for their own safety and the safety of their vehicle during the reservation;
   vi. not allow any vehicle other than the one specified in the reservation confirmation to occupy the Parking Space.
2. In connection with your reservation, you undertake to:
   i. keep the Parking Space clean and leave it in the condition found;
   ii. park without obstructing adjacent spaces or property;
   iii. notify the Owner and/or Park Aid immediately of any damage;
   iv. not cause damage, nuisance, inconvenience, or disturbance;
   v. not engage in illegal or immoral activity;
   vi. not conduct commercial activity;
   vii. use the Parking Space solely for parking;
   viii. not access other parts of the property, where applicable;
   ix. ensure the vehicle is properly taxed, insured, and roadworthy throughout the Reservation Period.

Failure to comply may result in cancellation without notice or refund, and you shall indemnify us for any losses incurred.

1. Termination

1. If you breach this Agreement, we may suspend or close your account and cancel current and future reservations without refund.
2. If your account is suspended or terminated, we may refuse to provide any further services. Attempts to circumvent this by creating new accounts may result in termination of all accounts.
3. Upon termination, provisions relating to existing reservations, fees, liability, and damages shall remain in force.

1. Liability of Park Aid

1. You are solely responsible for all communications and interactions with other users and third parties. Park Aid does not verify user statements or inspect Parking Spaces.
2. We are not liable for losses not caused by our breach, indirect losses, inaccuracies of information, or failure caused by events beyond our control.

1. Electric Vehicle Charging

1. You must follow all instructions related to the charging point and ensure safe use.
   This includes having appropriate cables, safe positioning, proper disconnection, and avoiding vehicle operation while connected.
2. You are responsible for any damage or injury caused by misuse and must notify the Owner and Park Aid immediately.
3. The Owner is responsible for the charging point and electricity supply. Park Aid bears no liability for losses or injuries arising from its use.

XII. General Provisions

1. This Agreement is governed by the Obligations and Contracts Act of the Republic of Bulgaria. Invalid clauses shall not affect the remainder of the Agreement.
2. You agree these terms are fair and reasonable.
3. Failure to enforce a right does not constitute a waiver.

XIII. Confidentiality

• The parties agree to keep all confidential information confidential and not disclose it without prior written consent.
• Reasonable measures shall be taken to protect confidential information.

XIV. Governing Law and Jurisdiction

This Agreement shall be governed and interpreted in accordance with the laws of the Republic of Bulgaria.
All disputes shall be resolved by the competent courts of the Republic of Bulgaria.
